A federal judge recently made a significant ruling in the case of Mohsen Mahdawi, a pro-Palestinian protest leader. This decision blocks the Trump administration’s attempt to deport him. Judge Nina Froes determined that federal authorities committed a procedural error by failing to certify a critical document they presented as evidence. This ruling emphasizes the importance of adhering to due process in legal proceedings.

Mahdawi expressed his appreciation for the court’s decision. “I am grateful to the court for honoring the rule of law and holding the line against the government’s attempts to trample on due process,” he stated. For Mahdawi, this ruling represents a step toward safeguarding his right to express his views on peace and justice, especially at a time when he believes such sentiments are at risk.

In response to the ruling, the Department of Homeland Security voiced its discontent. Spokeswoman Tricia McLaughlin insisted that the Trump administration remains steadfast in its pursuit to remove Mahdawi from the country. “No activist judge, not this one or any other, is going to stop us from doing that,” she asserted. This statement highlights the tension between the judiciary and the executive branch regarding matters of immigration and national security.

The core of Judge Froes’ ruling relates to the evidence presented by the government’s attorneys. They referenced comments made by Secretary of State Marco Rubio, who indicated that noncitizens could be removed if their presence jeopardized U.S. foreign policy interests. However, the government’s failure to properly certify the supporting document proved to be their undoing in this case, as Froes noted in her decision.

Mahdawi has a complex history. Detained in April 2025 during a citizenship appointment, he spent over two weeks in custody before being released on bail after filing a habeas corpus petition. A prior court ordered that he not be deported or removed from Vermont, showcasing the judicial system’s involvement in protecting individual rights.

His deportation case is also influenced by allegations dating back to 2015. During an FBI interview at a Vermont gun store, Mahdawi reportedly made inflammatory remarks. The store owner claimed he expressed interest in acquiring firearms, stating he had experience modifying weapons with intentions to commit violence. Such statements have drawn considerable attention and concern, casting a shadow over his advocacy efforts.

Mahdawi co-founded the Palestinian Student Union at Columbia University, alongside fellow activist Mahmoud Khalil, following a tragic event: the Hamas attack on October 7, 2023. This initiation was part of a broader movement aimed at raising awareness about Palestinian issues, although it has generated its share of controversies.
